These Terms of Service (“Terms”) govern your use of Orden OS (“Orden,” “we,” “us”), a salon-suite management platform. By creating an account or using Orden, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract under the laws of your jurisdiction. By using Orden, you represent that you meet these requirements.
2. Accounts
- You’re responsible for maintaining the security of your account, including your password.
- You’re responsible for any activity under your account.
- If you discover unauthorized access, contact us promptly at [email protected].
- One person, one account. Don’t share credentials. Owners who need additional staff access should contact us.
3. Owner and Provider relationship
Orden facilitates the working relationship between salon-suite owners and the providers who lease space from them, but Orden is not a party to that relationship. Owners and providers are independent of Orden, and Orden does not employ or engage either.
License agreements, rent, payments, taxes, scheduling, performance, and any disputes between owners and providers are between those parties. Orden provides software tools; the underlying business relationship is yours.
4. Acceptable use
Don’t use Orden to:
- Violate any law or anyone else’s rights.
- Impersonate someone, or misrepresent your affiliation.
- Upload illegal, infringing, harmful, harassing, or fraudulent content.
- Attempt to access data that doesn’t belong to you, or probe for vulnerabilities without permission.
- Use Orden to send unsolicited marketing or spam.
- Reverse engineer, scrape, or otherwise interfere with the service.
We may suspend or terminate accounts that violate these rules.
5. Your content
You retain ownership of the content you upload (photos, documents, profile information, calendar entries, etc.). You grant Orden a limited license to host, store, and serve your content as needed to provide the service to you and the people you authorize (e.g. providers in your salon).
You’re responsible for making sure you have the rights to upload the content you upload. Don’t upload other people’s photos, documents, or information without their permission.
6. Subscription and payment
Orden is currently free during early access. There are no subscription charges today, and we don’t collect payment details to create an account. When pricing begins, we’ll give you reasonable notice before it applies to your account, and you can cancel at any time. If a paid plan applies to you in the future and you stop paying, your account may be suspended and eventually closed; we’ll tell you before that happens.
Separately from your Orden account, payments you collect from your providers through the platform are handled by a third-party payment processor and carry processing costs that depend on the payment method. We’ll describe the current rates before you take your first payment.
7. Cancellation and termination
You can cancel your account at any time by contacting [email protected]. We’ll delete your data per the retention rules in our Privacy Policy.
We may terminate or suspend your account if you violate these Terms, if your use creates risk or legal exposure for us, or if maintaining your account is no longer commercially feasible. We’ll give you reasonable notice except where we believe doing so would cause harm.
8. Service availability
We work to keep Orden available and reliable, but we don’t guarantee uninterrupted service. Maintenance, outages, third-party issues (hosting, email, storage), and software bugs happen. We don’t commit to a specific uptime SLA on standard plans.
9. Disclaimer of warranties
Orden is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law. Use Orden at your own risk.
10. Limitation of liability
To the fullest extent allowed by law, Orden’s total liability to you for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost data.
11. Indemnification
You agree to indemnify and hold Orden harmless from claims arising out of your use of the service, your content, or your violation of these Terms.
12. Changes to these Terms
We’ll update these Terms as Orden evolves. When we make material changes, we’ll bump the policy version and ask you to agree again the next time you sign in. The current version and effective date are at the top of this page.
13. Governing law
These Terms are governed by the laws of the State of Minnesota, U.S.A., without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota.
